“Operator” company BAFIT s.r.o. with registered office at Štúrova 11, 811 02 Bratislava, ID number: 51 466 023 registered in the commercial register maintained by the District Court of the District Court Bratislava I, Department: s.r.o., Insert number: 126983/B
The operator provides services related to a healthy lifestyle, especially group exercises and other services. The method of providing services is understood as enabling the clients of the operation to participate in group trainings or to use the individual technical background of the operation.
“APCF” CrossFit center ALPHA PRIME is operated at Brestova Street 7, 821 08 Bratislava.
“Client” is a natural person older than 15 years who is authorized to use individual APFC facilities. It is shown with an identity card. A person under the age of 15 is allowed to enter only under the professional supervision of a trainer. The identification of the client at each entry to the APCF takes place in the form of checking the data from the member identification card and comparing the data in the operator’s system.
“APCF.Team” is/are an employee of the Operator, or another person authorized by the operator to supervise the use of services by the client, consulting, leading group trainings, or other activities directly related to the client’s activities in APCF and the use of services provided by the operator. The actions of the operator according to these conditions are also understood as the actions of APCF.Team.
“Price list” is an overview of the prices of services provided by operators in APCF. The currently valid price list can be viewed in the APCF and online on the website. The operator reserves the right to change prices in the price list.
“Opening Hours” are the hours during which APCF Services are available. The currently valid opening hours can be viewed in the APCF and online on the website. The operator reserves the right to change opening hours.
“Operating Regulations” is a summary of the Client’s rights and obligations in APCF drawn up by the operator, which, among other things, sets the conditions for the provision of services by the operator and with which the Client is familiar when entering APCF. Proper and sufficient familiarization with the operating procedure is a basic condition for the Client’s entry into the APCF. By entering the APCF, the client or other person confirms that they have fully familiarized themselves with all the provisions of the operating rules and that they understand them. The operating order is placed online on the website. The operator reserves the right to make changes to the operating procedure.
“ČIK (Member’s Identification Card)” is a card that the Client presents when receiving services provided by the Operator and is issued by the Operator at the first visit.
“Credit” funds that are credited to the Client at ČIK and in the information system of the operator, with which he pays for services provided or goods taken. Credit is valid for 1 year from the client’s last visit.
“Website” is the website www.apcf.sk through which individual services provided by the Operator can be booked.
“Trainer” is a person providing group and personal training for a fee in the internal or external state of the Operator.
“External trainer” is a person providing personal training and is not in the internal state of the Operator.
“Promotion” is a one-time event (group exercise, etc.) that is not part of the standard offer in the price list and is charged at a special price.
“Member” is the status in which the Client can use APCF services.
“Information System” is a system necessary for the operation of operational and economic activities necessary for the operation of APCF. The information system is operated by a third party (PerfectGym PL) using their capacities.
“Payment system” is a system necessary for the operation of economic activities necessary for the operation, reception and acceptance of non-cash transactions. The system is operated by a third party (Straal Payment Gateway Service) using their capacities and those of third parties.
The condition of registration (issue of ČIK and use of services) is to upload the Client’s photo into the system. If the Client refuses to save the photo in the system, he will not be allowed to use the service.


The Operator provides the Client with services in accordance with the operating procedure for a fee in the sense of the Price List.
The operator reserves the right to change the schedule of group exercises.
The operator is entitled to provide, at the client’s request, a statement of top-ups/credit withdrawals and the history of his visits, but no more than a year back from the last visit.
APCF.Membership is valid for 1 month from purchase. It provides the possibility of unlimited entrances to the Gym (OpenGym), the possibility of booking and purchasing Group training (CrossFit training, Functional training, Weightlifting). If the membership is not canceled by sending a written request to the mail: info@alphaprimecrossfit.com before its expiration, it is automatically renewed and extended by 1 month each time. If the member wants to renew his canceled membership again, he will pay a RAP (reinitialization administrative fee) in the amount of 10 Euro every time he wants to renew it. APCF.Membership Month membership is valid for 1 month since purchase. It provides the possibility of unlimited entrances to the Gym (OpenGym), the possibility of booking and purchasing Group training (CrossFit training, Functional training, Weightlifting). Membership is automatically canceled after 1 month. APCF.Membership Year membership is valid for 13 months from purchase. It provides the possibility of unlimited entrances to the Gym (OpenGym), the possibility of booking and purchasing Group training (CrossFit training, Functional training, Weightlifting). Membership is automatically canceled after 13 months.
The current price of APCF.Membership, APCF.Membership Month and APCF.Membership Year is listed in the Price List, which is always available at the store as well as on the apcf.sk website
In the event of closure of operations due to technical reasons, or by law, the right to return the aliquot amount, or extension of the validity of activated membership APCF.Membership, APCF.Membership Month, APCF.Membership Year does not arise for the client.
In case of inability to use the purchased APCF.Membership, APCF.Membership Month, APCF.Membership Year (due to health/personal reasons), the client does not have the right to refund the aliquot amount/extend the validity of APCF.Membership.
During the first visit, a photo of the client’s face is taken at the reception, which is stored in the operator’s system and serves to identify the client at each visit to APCF. In the event that the photo does not correspond to reality, the Operator has the right to request verification of the client’s identity by showing a valid document (citizen’s card, passport). In the event that the client refuses to take a photo of his face, the Operator reserves the right not to allow the client into the APCF premises, and the client is not entitled to a refund for the purchase of APCF.Membership, APCF.Membership Month, APCF.Membership Year membership.
The Member Identification Card serves to identify the client, it is non-transferable and specific for each Client. Without a Member Identification Card, the Client will not be allowed to enter the APCF. In case of loss/stolen/damage/forgetting, the Client will be issued a new Member Identification Card for a fee of EUR 5 or in accordance with the valid Price List.
Only one person is allowed to enter one APCF card.
The client is obliged to observe the opening hours.
The client can top up Credit with a payment card when visiting APCF and/or on the website.
The client is obliged to check the block from the register at the time of its issuance. Additional complaints are not accepted.
Services and goods purchased by the Client during the APCF visit are recorded in the system. They are withdrawn from the client’s credit as part of the monthly settlement.
In the case of a request to reserve group exercises, the client must have purchased APCF.Membership, APCF.Membership Month, APCF.Membership Year membership. Reservations can only be made if there is sufficient credit. In case the Client does not attend the booked lesson:
will cancel the reservation within a time limit of 24 hours. and more before the reserved time, the credit will be returned to him

Reservations can be made via the website, in person at the reception or by phone.
Each group exercise is limited by the number of clients. In the event that the capacity of the given lesson is filled, the Operator may refuse to provide the service to the Client without the right to a refund. The group exercise lasts 60 minutes. The client is obliged to come to the group exercise before it begins. The tolerated delay of the Client is 5 minutes after the start of the group exercise. If the Client’s delay is more than 5 minutes after the start of the group exercise, the Client is obliged to accept the trainer’s decision to allow or deny entry to the group exercise.
If the capacities of individual sports grounds are exceeded, the Operator is entitled not to allow the Client to enter. In this case, the client is not entitled to a refund or a right to extend the validity of APCF.Membership, APCF.Membership Month, APCF.Membership Year.
In case of forgetting, losing, stealing, damaging or misplacing the Member Identification Card and requesting a new one, the client is obliged to provide proof of identity. When creating a new card due to forgetfulness/loss/theft/damage, a fee of 5 EURO is charged or according to the valid Price List.
For safekeeping of valuables, upon request, the Operator will provide a safe for a fee according to the valid Price List.
Numbered lockers with locks are used to store things.
The Operator’s liability for damage caused to the Client is governed by valid legal regulations. The Operator is not responsible for damage to things brought in or left in the APCF, if they are left outside the places reserved by the Operator for storing things. If the user stores valuables in the safe, the value of which exceeds the amount of EUR 100, he is obliged to report this at the reception, otherwise the Operator is not responsible for damage caused by their theft exceeding the given amount. The operator recommends that clients keep things of more value

as EUR 100 (as well as cash) to the safe.
The client is obliged to empty the locker and leave it unlocked when leaving. The operator has the right to forcibly open lockers that remain locked even after the operating hours. The operator is not responsible for any damages or losses caused by the violation of the obligation to leave the cabinet empty and unlocked.
The Client is not entitled to make any claims from the Operator due to reasonable and justified restrictions on the operation of the APCF (sports, social or other events) as long as he was informed about them in advance.
The operator has the right to lease the APCF or part of it to another person or persons.
The operator reserves the right to interrupt or limit the operation of APCF in justified cases. This applies especially in the case of necessary repairs and maintenance, which are not compatible with maintaining normal and comfortable and safe operation for the members, as well as in a situation caused by force majeure (e.g. breakdown of water pipes, water supply, or supply of hot water, failure of electricity, heating and similar external influences). In this case, the user is not entitled to compensation.
The Client is obliged to follow all the guidelines and instructions of the Operator located at the premises during the entire period of the APCF visit.
The ban on entry into operation of the APCF applies to:
Persons under the influence of alcohol or toxic substances
Persons with animals – it is forbidden to enter the exercise area with any animal. The dog is only allowed in the entrance and the area around the reception. The owner bears full responsibility for his dog. Free movement of the dog is prohibited.
Persons suffering from communicable, infectious diseases (in case of doubt, the client may be asked for confirmation from a doctor) or persons with open wounds, or skin problems, or suffering from any disease that threatens the health of other clients
Persons who intend to use APCF premises for commercial or non-standard use without the permission of the responsible person (operations manager)
Dirty persons in dirty clothes
The following are prohibited in APCF operation:
Smoking
Bringing in and using glass objects (including bottles)
Interference with technical equipment
The client is obliged to:
to observe cleanliness and hygiene in the premises of the Operation, also in case of detection of any deficiency, to inform the responsible senior employees,
to inform employees without delay in the event of a sudden deterioration of the health condition, possible observation of health problems,
treat the Company’s equipment with care and do not damage the Company’s premises and property,
use clean and suitable sports shoes,
follow the coach’s instructions,
after finishing the lesson, put the used tools in the place designated for them


In the event of non-compliance with the Client’s obligations listed in points (the Client is obliged), the Operator, through the on-duty trainer, will ask to leave the premises of the fitness center and terminate the validity of the APCF.Membership, APCF.Membership Month, APCF.Membership Year membership without the right to compensation.
The Operator bears no responsibility for injuries and injuries caused by the client through his own carelessness or non-compliance with the Operating Rules.
Clients use APCF at their own risk, without the right to object to the Operator.
The user participates in the exercise at the Operator’s premises at his own risk, is healthy physically and mentally and is able to complete the exercise. Before each exercise, he considers his current state of health and adjusts the type of exercise, intensity, load and length of the exercise accordingly.
In case of provable intentional damage to the Operator’s property, the Client is obliged to compensate the damage in full.
In the event that the Client causes damage by his actions, by which he violated his above-mentioned obligation or another legal obligation, he is fully responsible for it in accordance with the provisions of § 420 of Act No. 40/1964 Coll. (Civil Code, LIABILITY FOR DAMAGE, General Liability) as amended.

The general terms and conditions are valid from April 15, 2019
